Liberaal Collectief Amsterdam naar civiele rechter: “Democratische legitimiteit Amsterdamse raad in geding”

AMSTERDAM, 29 April 2026 – Het Liberaal Collectief Amsterdam (LCA) legt zich niet neer bij de onbevoegd verklaring van de Raad van State over de vaststelling van de verkiezingsuitslag. Nu de bestuursrechter aangeeft niet over de inhoud te kunnen oordelen, kondigt LCA-voorman Paul de Jong een gang naar de civiele rechter aan.
“Het is teleurstellend dat de Raad van State enerzijds voorstander is van modernisering van de verkiezingsrechtspraak en anderzijds zich gebonden voelt aan huidige, beperkte wettelijke kaders. Het is nu aan de rechter om inhoudelijke toetsing aan het EVRM voor te bereiden.”
De partij eist volledige transparantie over een opeenstapeling van onregelmatigheden die de uitslag van 18 maart hebben vertroebeld. Onlangs gaven 11 andere kleine politieke partijen aan ook moeite te hebben met het ongelijke speelveld. LCA diende eerder al bezwaar en beroep in.
In de vandaag gepubliceerde uitspraak verklaarde de Afdeling bestuursrechtspraak van de Raad van State zich onbevoegd. De Raad wees daarbij echter expliciet op de weg naar de burgerlijke rechter voor rechtsbescherming.
“Het is een procedurele uitspraak, geen inhoudelijke,” aldus De Jong. “De fundamentele vragen over de ongelijke behandeling van nieuwe en kleine partijen, de strategische positionering van gemeentelijke verkiezingsborden en de structureel lage opkomst in specifieke stadsdelen blijven onbeantwoord.”
De democratische kade van Amsterdam is aan onderhoud toe, want anders geldt in de bestuurlijke republiek Amsterdam het recht van de sterkste en niet van diversiteit.
LCA zet de strijd voort op twee fronten. Naast de voorbereiding van de civiele procedure loopt er een verzoek op basis van de Wet open overheid (WOO).
De partij wil inzage in:
– Ambtelijke besluitvorming rond verkiezingsorganisatie
– Inzetbaarheid van personeel
– Effecten van kieshulpen en peilingen
– Ongelijke toegang tot media en debat
– Beleidsfalen rond opkomstverschillen
– Verloop van de verkiezingscampagne
Het Liberaal Collectief Amsterdam benadrukt dat deze nationale juridische stappen noodzakelijk zijn op basis van de feiten en omstandigheden en dat de weg naar het Europees Hof voor de Rechten van de Mens open blijft staan.
Toetsing aan EVRM-wetgeving is cruciaal voor de beoordeling van een cumulatie van omstandigheden die hebben geleid tot een oneerlijk speelveld en een vertekende uitslag.
De legitimiteit van de nieuw geïnstalleerde raad staat wat het LCA betreft ter discussie zolang de twijfel over het verkiezingsproces niet door onafhankelijk onderzoek is weggenomen.

AMSTERDAM, 29 April 2026 – Liberal Collective Amsterdam (LCA) does not accept the Council of State’s declaration of lack of jurisdiction regarding the determination of the election results. Now that the administrative court has indicated it cannot rule on the substance of the case, LCA leader Paul de Jong announces that the matter will be brought before the civil court.
“It’s disappointing that the Council of State, on the one hand, advocates modernization of electoral jurisprudence, while on the other hand feels bound by the current, limited legal framework. It is now up to the civil court to prepare a substantive review under the European Convention on Human Rights (ECHR).”
The party demands full transparency regarding a series of irregularities that have clouded the election results of 18 March. Recently, 11 other small political parties also expressed concerns about the unequal playing field. LCA had previously filed both an objection and an appeal.
In its ruling published today, the Administrative Jurisdiction Division of the Council of State declared that it lacked jurisdiction. However, it explicitly pointed to the possibility of seeking legal protection through the civil courts.
“This is a procedural ruling, not a substantive one,” said De Jong. “Fundamental questions regarding the unequal treatment of new and small parties, the strategic placement of municipal election billboards, and the structurally low turnout in specific districts remain unanswered.”
Amsterdam’s democratic foundations need maintenance; otherwise, the administrative republic of Amsterdam risks becoming a system where the law of the strongest prevails rather than diversity.
LCA will continue its efforts on two fronts. In addition to preparing civil proceedings, a request has been filed under the Government Information (Public Access) Act (WOO).

Liberal Collective Amsterdam emphasizes that these national legal steps are necessary based on the facts and circumstances, and that the path to the European Court of Human Rights remains open.
Review under ECHR standards is crucial to assess the cumulative effect of circumstances that have led to an uneven playing field and a distorted outcome.
In LCA’s view, the legitimacy of the newly installed city council remains in question as long as doubts about the electoral process have not been removed through independent investigation.

AMSTERDAM, 2 april 2026 – Liberal Collectief Amsterdam (LCA) heeft officieel beroep ingesteld bij de Raad van State tegen de vaststelling van de verkiezingsuitslag van de gemeenteraadsverkiezingen 2026. De politieke partij eist een volledige herstemming in de hoofdstad vanwege een structureel ongelijk speelveld en een historisch lage, ongelijk verdeelde opkomst die de legitimiteit van de nieuwe raad ondermijnt.
Hoewel de nieuwe gemeenteraad gisterenmiddag werd geïnstalleerd ligt er nu een lijvig beroepschrift bij de Afdeling Bestuursrechtspraak in Den Haag. Volgens LCA-bestuurslid Paul de Jong is er geen sprake geweest van vrije en gelijke verkiezingen zoals gewaarborgd in het Europees Verdrag voor de Rechten van de Mens (EVRM).
Democratische uitsluiting in de wijken
De kern van het beroep richt zich op de enorme verschillen in opkomst tussen de Amsterdamse wijken. Terwijl het stedelijk gemiddelde op 47,1% lag bleef de opkomst in wijken in Zuidoost en Nieuw-West steken tussen de 20 en 30%. “Als dat percentage werd doorgetrokken naar een quorum voor de besluitvorming in de raad dan zou men niet aan besturen toekomen.” In de H-buurt werd een absoluut dieptepunt bereikt van slechts 17,1%.
Eerder stelde politicoloog Vermeulen (UvA) al in het Parool dat de gemeente Amsterdam te weinig heeft gedaan om het opkomstpercentage in ondergenoemde wijken te verbeteren.

Invloedrijke kieshulpen sloten een aanzienlijk deel van de deelnemende partijen (35 in totaal) uit.

Verzoek tot Voorlopige Voorziening
Naast het beroep heeft LCA een verzoek om een voorlopige voorziening ingediend. De partij verzoekt de Raad van State om de werking van de vastgestelde uitslag te schorsen en de besluiten van de nieuw geïnstalleerde raad op te schorten in afwachting van een onafhankelijk extern onderzoek.

Over LCA
LCA nam in maart 2026 voor het eerst deel aan de gemeenteraadsverkiezing. De lokale liberale politieke partij richtte zich op meer betaalbare woningen, individuele vrijheid en inclusie en herstel van verdienvermogen door minder regels en meer innovatie.

AMSTERDAM, April 2, 2026 – Liberal Collective Amsterdam (LCA) has lodged an official appeal with the Dutch Council of State challenging the certification of the 2026 municipal election results. The party demands a complete re-vote due to a structurally uneven playing field and historically low, uneven voter turnout that undermines the new council’s legitimacy.
The new city council was installed yesterday afternoon, but LCA has submitted a comprehensive appeal to the Administrative Jurisdiction Division in The Hague. LCA board member Paul de Jong states there were no free and equal elections as protected by the European Convention on Human Rights (ECHR).
Voter Turnout Disparities
Citywide turnout averaged 47.1%, but dropped to 20-30% in Zuidoost and Nieuw-West, with a record low of 17.1% in the H-Buurt. “If those percentages set the quorum for council decisions, governing would be impossible,” the appeal argues.
